Dear Heather,
I respectfully disagree. You are right that everybody CAN make up a image
database with CC-BY images and sell them. But nobody has to buy them from
there (or from CCC). Instead everybody can use any image for free. In the
case of CC-BY-NC I doubt that many authors think that despite the -NC the
publisher may sell the article or parts thereof. Unfortunately due to
regulations in the author agreement the publisher quite often has the right
to do so despite -NC. Alas, still nobody has to buy the figure or anything
else from CCC. If it's used for a scientific purpose. Citing the figure and
some kind of intellectual investigation is enough. Many legislations call
this Fair Use, but the principle is valid also in others like the German
(where there is no Fair Use-doctrine).
