[GOAL] Re: Status of OUP/ESA copyrights on PDF files of journal articles that were never copyrighted

To reply to Tom Walker's question - Do those who make PDFs of journal
articles that were never copyrighted have a valid claim to a copyright of
their PDF of the article? - no, in Berne countries. Copyright dates from
first fixation in a medium. Whether this is fixation on paper of PDF makes
no difference.


However, I'm not sure what the position is in a Johnny-come-lately-to-Berne
country like the US, though (thinking of the protracted copyright life of
"Happy Birthday").
