[BOAI] Re: IOP Publishing moves to CC-BY licence for open access articles and bibliographic metadata

Good news. I'm curious about the statement on "bibliographic metadata":
isn't it the case that metadata is always free to use, without a need for
any license? Bibliographic metadata are just statements of facts (person X
published paper Y ...) - that's nothing that could be copyrighted. Even if
an abstract is included, it still comprises no more than 5% of the work and
can be freely used under "fair use" principle, even for Toll Access papers
- correct me if I'm wrong.
I'm pointing this out because any confusions in this area work against OA
and academia. I think scholars should know their rights and not rely on
publishers for clarifications, as some publishers may be more willing to
introduce even more fuzz than to teach scholars their rights (I mean
publishers in general, not particularly IOP).
