The European Union has a proposal for a directive on orphan works that
would result in open access to much of the orphan litterature.

However France is trying to kill it by means of a new law proposal
presented in the French senate, that would essentially impose
Compulsory Collective Management for digital exploitation of 20th
century works, so as to make sure that nothing is made available for
free.

I am working on a document (in French) commenting on this.  Tell me if
you are interested.

The purpose is to avoid the competition of orphan works.

in a nutshell, after so many criticisms of Google, France in
implementing internally the Google settlement without Google, and
violating even more the exclusive rights of its own authors.

The stand against the Google settlement was just a money grab.

It is not clear yet whether there will be any serious opposition
against that French bill.  Most people do not understand the issues,
which are indeed complex.
